GAMEWORKS EQUIPMENT RENTAL AGREEMENT
By clicking the checkbox, you agree to this Rental Agreement ("Agreement"). Entered into as of the date of order by and between Hassan Khalil ("Lessor"), and the customer (“Lessee”)
RENTAL TERM
The rental period ("Term") begins on the date the equipment is received. This Agreement shall continue on a week-to-week basis until terminated by either party.
FEES AND PAYMENT
Weekly Rental Fee: Lessee shall pay amount agreed upon during checkout for the Equipment, due once a week on the day of the week the product was delivered.
Late Fees: Once a rental is canceled and a shipping label has been sent, the lessee has 3 business days to return the equipment. If the equipment is not shipped with those 3 business days, the lessee shall be charged $3.00 per day until the equipment is return.
USE OF EQUIPMENT
Lessee agrees to:
- Use the Equipment solely for personal, non-commercial purposes.
- Not modify, disassemble, or expose the Equipment to liquids, extreme temperatures, or hazardous environments.
- Return the Equipment in the same condition as received, excluding reasonable wear and tear.
- Not lend, lease, or transfer the Equipment to any third party.
LIABILITY AND DAMAGES
Damage or Loss: Lessee assumes full financial responsibility for repair or replacement costs if the Equipment is damaged, lost, or stolen. Replacement costs shall be based on the Equipment’s current market value.
Indemnification: Lessee agrees to indemnify and hold Lessor harmless from any claims, damages, or liabilities arising from the use of the Equipment.
Limitation of Liability: Lessor is not responsible for any injuries, damages, or losses resulting from the use or malfunction of the Equipment.
TERMINATION
By Lessor: Lessor may terminate this Agreement immediately if Lessee breaches any terms (e.g., non-payment, misuse).
By Lessee: Lessee may terminate by returning the Equipment and settling all outstanding fees. No refunds will be issued for partial weeks.
RETURN OF EQUIPMENT
Once a rental is canceled, the lessee will receive a shipping label. The lessee has 3 business days from the time the shipping label is sent to return the equipment. Failure to return the Equipment will result in a daily late fee of $3.00 a day and potential legal action.
GOVERNING LAW
This Agreement is governed by the laws of California. Any disputes shall be resolved in the courts of Yolo County.
ENTIRE AGREEMENT
This document constitutes the entire agreement between the parties. Amendments must be made in writing and signed by both parties.
IN WITNESS WHEREOF, the parties have executed this Agreement as of the Effective Date.
